Who we are

Américas Bikers Tours and Rentals S.A.S NIT 901.653.570-7 (hereinafter, “Américas Bikers” or “the Company”) is a company dedicated to the sale of motorcycle tours, motorcycle rental and sale of accessories for motorcycles and motorcyclists. The Company is committed to protecting and guaranteeing the privacy and security of the personal data of its customers, suppliers, employees and other holders of personal data (hereinafter, “Holders”) in compliance with Law 1581 of 2012 and Decree 1377 of 2013, and other regulations that complement, modify or add to them.

Object

The purpose of this document is to establish the policy of protection and privacy of personal data of Américas Bikers, in order to ensure the proper treatment and protection of the personal data of the Holders, and to comply with the obligations established in the applicable Colombian regulations.

Principles

Américas Bikers guarantees the processing of personal data in accordance with the following principles:

  • Legality: The processing of personal data will be carried out in accordance with the legal provisions applicable in Colombia.
  • Purpose: Personal data will be processed for legitimate, specific and explicit purposes, previously informed to the Data Subject.
  • Freedom: The processing of personal data will only be carried out with the prior, express and informed consent of the Data Subject.
  • Truthfulness and quality: The information processed shall be truthful, complete, accurate, updated and verifiable.
  • Transparency: The Data Subject shall have the right to access at any time to the information about him/her.
  • Security: Personal data will be stored and treated in a secure and confidential manner, in order to avoid its loss, adulteration, access or unauthorized consultation.
  • Confidentiality: Employees, suppliers and third parties that process personal data shall be obliged to guarantee the confidentiality of the information.

Purposes of the processing of personal data

Américas Bikers may process personal data for the following purposes:

  • Manage and administer the services offered by the Company, such as the sale of motorcycle tours, motorcycle rentals and the sale of accessories.
  • To carry out marketing and promotional activities, including sending information about products, services, events and news of interest.
  • Comply with legal, tax and regulatory obligations applicable to the Company.
  • Evaluate the quality of services and conduct internal studies on consumer habits.
  • Manage selection, hiring and personnel administration processes.

Rights of Owners

The Holders shall have the following rights:

  • Know, update and rectify your personal data.
  • Request proof of consent given for the processing of your personal data.
  • Be informed about the use that has been made of your personal data.
  • To file complaints before the Superintendence of Industry and Commerce for violations of the provisions of the applicable regulations.
  • To revoke consent and/or request the deletion of their personal data when the treatment does not respect the principles, rights and constitutional and legal guarantees.
  • Access free of charge to your personal data that has been processed.

Procedures for the exercise of the rights of the Data Controllers

The Holders may exercise their rights by sending a written request to Américas Bikers, to the following e-mail address: protecciondedatos@americasbikers.com.co The request must contain the identification of the Data Subject, a description of the facts giving rise to the request, the address and other contact details of the Data Subject.

Américas Bikers will respond to the requests of the Holders within a maximum term of fifteen (15) business days from the date of receipt. When it is not possible to attend the request within such term, the Holder will be informed of the reasons for the delay and the date on which the request will be attended, which in no case may exceed eight (8) business days following the expiration of the first term.

Information security

Américas Bikers will adopt the necessary technical, administrative and physical measures to guarantee the security of personal data and avoid its alteration, loss, treatment or unauthorized access. All personnel who process personal data shall be obliged to comply with the security measures adopted by the Company.

Transfer and transmission of personal data

Américas Bikers may transfer and/or transmit the personal data to third parties in charge of the processing, as long as the fulfillment of the purposes set forth in this policy is guaranteed and the legal provisions applicable in Colombia are complied with.

Validity

This policy of protection and privacy of personal data is effective from the date of its publication and will remain in force as long as Américas Bikers processes personal data. The Company reserves the right to modify this policy at any time, and will give notice to the Holders of such modifications through the means of communication it deems appropriate.
